What is CTE (Consent to Establish)? || स्थापित करने के लिए सहमति क्या है?

CTE-Consent to establish is NOC given by UEPPCB which is required before you start your business or enterprise as per The Water (Prevention & Control of Pollution) Act – 1974 and the air (prevention and control of pollution) act, 1981. It is mandatory to obtain CTE from the respective State Pollution Control Board (UEPPCB) before the commencement of the business. The Process requires the application in prescribed format along with required documents and fees followed by Inspection.

CTE- सहमति स्थापित करने के लिए UEPPCB द्वारा दी गई NOC है जो आपको जल अधिनियम 1974 और वायु अधिनियम 1981 के अनुसार अपना व्यवसाय या उद्यम शुरू करने से पहले आवश्यक है। व्यवसाय शुरू होने से पहले संबंधित राज्य प्रदूषण नियंत्रण बोर्ड (UEPPCB) से CTE प्राप्त करना अनिवार्य है । प्रक्रिया को आवश्यक दस्तावेजों और निरीक्षण के बाद फीस के साथ निर्धारित प्रारूप में आवेदन की आवश्यकता होती है।

What is CTO (Consent to Operate)? || संचालित करने के लिए सहमति क्या है?

CTO- Consent to operate as it is known is NOC given by State pollution control board (UEPPCB) to operate your business after you have received your CTE NOC from SPCB(UEPPCB) as per The Water (Prevention & Control of Pollution) Act – 1974 and the air (prevention and control of pollution) act, 1981. The procedure involves the filing of the respective application in the prescribed format, documents, and fees for the application followed by inspection and after this process CTO is issued.

सीटीओ- जैसा कि ज्ञात है कि इसे संचालित करने के लिए राज्य प्रदूषण नियंत्रण बोर्ड (UEPPCB) द्वारा दिया गया एनओसी आपके व्यवसाय को संचालित करने के लिए है जब आपने जल अधिनियम 1974 और वायु अधिनियम 1981 के अनुसार एसपीसीबी (UEPPCB) से अपना सीटीई एनओसी प्राप्त किया हो। आवेदन के लिए निर्धारित प्रारूप, दस्तावेजों और फीस का संबंधित निरीक्षण और उसके बाद इस प्रक्रिया के बाद सीटीओ जारी किया जाता है।

Which Category does my industry fall under? || मेरा उद्योग किस श्रेणी में आता है?

Industries are classified into four categories by Uttarakhand Environment Protection & Pollution Control Board Based on what your work and how much pollutants are released with that job work/business/manufacturing.

उत्तराखंड प्रदूषण नियंत्रण समिति द्वारा उद्योगों को चार श्रेणियों में वर्गीकृत किया गया है जो आपके काम और उस कार्य / व्यवसाय / विनिर्माण के साथ कितने प्रदूषकों के आधार पर जारी किए जाते हैं।

1.White (व्हाईट)

2. Green (गृीन)

3. Orange (ओरेंज)

4. Red (रैड)

Who shall get a pollution control NOC? || किसे मिलेगा प्रदूषण नियंत्रण एनओसी?

The Uttarakhand Environment Protection & Pollution Control Board shall grant the Pollution Control No Objection Certificate (NOC) the industries which are permissible in the mixed land use areas or zones as per by-laws of the Master Plan notified by Uttrakhand governing authority or the draft master plan. 

Any industry or enterprise established in the designated or approved area(s).

उत्तराखंड प्रदूषण नियंत्रण समिति अधिसूचित मास्टर प्लान या ड्राफ्ट मास्टर प्लान के उपनियमों के अनुसार मिश्रित भू उपयोग क्षेत्रों या क्षेत्रों में अनुमत उद्योगों को प्रदूषण नियंत्रण अनापत्ति प्रमाणपत्र (एनओसी) प्रदान करेगी।

निर्दिष्ट या स्वीकृत क्षेत्र में स्थापित कोई उद्योग या उद्यम।

Who cannot get a pollution control NOC? || कौन प्रदूषण नियंत्रण एनओसी प्राप्त नहीं कर सकता है?

The establishment of any industry is not allowed in any of the approved residential areas of Uttrakhand shall be given consent to establish by state pollution control board within the Municipal Corporation limits of  Uttrakhand except in the designated industrial area/zone. 

Any industry which is established at any area other than the designated or approved area / zone shall not be granted the Pollution Control NOC by the Uttrakhand Pollution State Board.

उत्तराखंड के स्वीकृत आवासीय क्षेत्र में किसी भी उद्योग की स्थापना की अनुमति नहीं है और निर्दिष्ट औद्योगिक क्षेत्र को छोड़कर नगर निगम सीमा के भीतर राज्य प्रदूषण नियंत्रण बोर्ड द्वारा स्थापित करने के लिए उद्योग की किसी भी श्रेणी को सहमति दी जाएगी।

किसी भी उद्योग को जो निर्धारित या अनुमोदित क्षेत्र / क्षेत्र के अलावा किसी भी क्षेत्र में स्थापित किया गया है, उसे उत्तराखंड प्रदूषण राज्य समिति द्वारा प्रदूषण नियंत्रण एनओसी प्रदान नहीं की जाएगी।

What is the Procedure for Obtaining UEPPCB NOC? || UEPPCB NOC प्राप्त करने की प्रक्रिया क्या है?

• Identifying the applicability and eligibility of the establishment or industry.

(स्थापना या उद्योग की प्रयोज्यता और पात्रता की पहचान करना।)

• Identifying the category and location of the respective industry or establishment.

(संबंधित उद्योग या प्रतिष्ठान की श्रेणी और स्थान की पहचान करना।)

• Preparation of drafts for filing of the application for UEPPCB NOC.

     (यूपीपीसीबी एनओसी के लिए आवेदन दाखिल करने के लिए ड्राफ्ट तैयार करना।)

• Preparation & Filing of application for UEPPCB NOC.

(यूपीपीसीबी एनओसी के लिए आवेदन की तैयारी और फाइलिंग।)

• Post filing of the application the same is scrutinized by the authorized officers of the UEPPCB.

(आवेदन की फाइलिंग के बाद यूपीपीसीबी के अधिकृत अधिकारियों द्वारा जांच की जाती है)

• On scrutiny, every industry filing the application is subject to Inspection by the designated officer.

(आवेदन दाखिल करने वाले प्रत्येक उद्योग को नामित अधिकारी द्वारा निरीक्षण के अधीन किया जाता है।)

• On conduction of successful and satisfactory scrutiny, the NOC is issued by the UEPPCB.

(UEPPCB द्वारा सफल और संतोषजनक जांच के बाद NOC जारी की जाती है।)

What is the fee charged by UEPPCB for NOC? || NOC के लिए UEPPCB द्वारा कितना शुल्क लिया जाता है?

The Fees for UEPPCB NOC (CTE and CTO) depends on various factors such as the Fixed Cost of the Project, Category of Business, and penalty imposed (if any) by the UEPPCB.

फीस विभिन्न कारकों पर निर्भर करती है जैसे UEPPCB द्वारा परियोजना की निश्चित लागत, व्यवसाय की श्रेणी और जुर्माना (यदि कोई हो) ।

What are the Documents needed for UEPPCB NOC? || UEPPCB NOC के लिए कौन से दस्तावेज़ आवश्यक हैं?

• Certificate from CA regarding Capital investment in Fixed Assets

(फिक्स्ड एसेट्स में पूंजी निवेश के संबंध में सीए से प्रमाण पत्र)

• Approved Location or Site Plan of the Business Entity.

           (बिजनेस एंटिटी का स्वीकृत स्थान या साइट प्लान।)

• Proof of ownership or occupancy such as Registry or Lease Deed or Rent Agreement indicating the details of the location of the property.

(स्वामित्व या अधिभोग का प्रमाण जैसे कि रजिस्ट्री या लीज डीड या रेंट एग्रीमेंट संपत्ति के स्थान का विवरण दर्शाता है।)

• Documents of formation of an entity like Partnership Deed / Memorandum of Article of Association / GST Certificate in case of Proprietorship.

           (पार्टनरशिप डीड पार्टनरशिप डीड या MOA तथा प्रोपराइटरशिप के मामले में जीएसटी सर्टिफिकेट।)
