What is Department of Telecommunications (DOT)

Department of telecommunication is governed under the Ministry of Communications (Sanchar Mantralaya) Department of Telecommunications (Door Sanchar Vibhag). Following are the functions of the Department of Telecommunication:

  • Formulation of policies relating to telecommunications, granting licences, regulation and management of matters relating to all forms of communications.
  • Development and standardization of research and development in telecommunications.
  • Assessing the quantum of private investment in Telecommunications.
  • Ensuring telecommunications networks are secure and keep cyber threats in check
  • Providing financial assistance for the research and development of telecommunications technology and for providing adequate training to manpower for telecom programme.
  • Acquiring of stores and equipment required by the Department of Telecommunications.

Overview of DOT - OSP (Other Service Providers)

Other Services providers covers non-telecom service providers who provide Business Process Outsourcing services, Call centre Service, telebanking or tele-marketing service, network operation centres, vehicle tracking systems services or any other services apart from those of ISP and TSP. In India, it is mandatory for an OSP to apply to the DOT (Department of Telecommunication) in the prescribed manner along with the requisite documents, in order to seek registration under the respective category before beginning to provide any such service(S). DOT is the sole authority for approving and granting any OSP licences.

As per the regulatory provisions relating to OSP, the other Service Providers shall take the requisite telecommunication resources from authorized Telecom Service Providers only and they will not provide switched telephony. Application for Registration of OSPs and Telemarketers is scrutinised and approved by the respective Telecom Enforcement, Resource and Monitoring (TERM) Cells (previously referred to as VTM Cells) as per location of the OSP/Telemarketing Centre.

The Service Providers before providing them telecom resources must ensure that the customers have valid registration papers from the OSP Cell of DoT. Access service provider will penalised who do not adhere to the above requirement.

Types of DOT OSP

➲ Domestic DOT OSP License – Domestic OSP license is required if the call is in India only (domestic calls). With this type of registration, international calling is not allowed.

➲ International DOT License – It requires an international DOT license if the call is outside India. In this type of registration, the domestic call is not permitted.

➲ Domestic and International Registration-This form of license enables you to call in India as well as outside India. The combined license requirement is for centers were minimum 50 seats and the Rs 50 Lakh bank guarantee to be furnished to the government.

Conditions of OSP Licence

  • The Registration fees charged by the DOT for application of OSP is INR 1000/- per application.
  • OSP licence once issued has a validity of 20 years unless otherwise specified by the DOT.
  • The validity of OSP may be extended by a period of 10 years at a time on application by the OSP before the expiry of their licence
  • Other service providers, on-demand by the DOT,  shall be bound to submit such information and documents within the stipulated timeline.
  • OSP shall submit the annual return mentioning the details of the operations and acitivities of the previous financial year and future course of action, within 6 months of completion of financial year.

Procedure for registration:

STEP 1. Create an account on Saral Sanchar website

STEP 2. Click for DOT OSP license

STEP 3. Fill the form properly with all correct information

STEP 4. Attach all required attachment (all documents must be digitally signed)

STEP 5. Pay the required fee through the online payment option.

STEP 6. Remove all error if any error appears and then submit the form

STEP 7. Department will check the information and all attached attachments and raise clarification if they needed.

STEP 8. Submit the clarification if raised within a stipulated time limit.

STEP 9. Department will issue the License if all information is true and correct.

 

Documents required for DOT OSP Registration

  • Certificate of Incorporation of the Company
  • Articles of Associaton & Memorandum of Association of the applicant Company
  • Power of Attorney or Board resolution authorizing the authorised signatory to sign the application & documents
  • Description of nature of business / activities business of the proposed OSP Centre
  • Details of present Directors of the Company.
  • Detail shareholding pattern of the company indicating equity details
  • Network diagram approved by the TSP 
  • Challan of INR 1000/- for payment of Fees for OSP Registration.

The digital signature of the authorised Director shall be affixed on all the aforementioned documents and application of OSP.

Registration Validity

Registration shall valid for 20 years from the date of issue unless otherwise mentioned in the registration letter

Registration validity may be extended, if deemed expedient, the period of registration by 10 years at one time, upon request of the OSP, if made during the 19th year of the registration period on the terms mutually agreed. Designated authority decisions shall be final in regard to the grant of extension.
