Introduction

As per the rule, solid waste means Means and includes solid or semi-solid domestic waste, sanitary waste, commercial waste, institutional waste, catering and market waste and other non-residential waste, street sweeping, silt removed or collected from surface drainage, horticultural waste, agricultural waste, and dairy waste, bio-medical waste treatment excluding industrial waste, bio-medical waste and e-waste, battery waste, radioactive waste generated in the area under the local authorities and other entities mentioned in rule 2

As per Solid Waste Management Rules, 2015 any individual or group of persons, residential and non-residential premises including Indian Railways, defense establishments that generate solid waste are classified as waste generators.

Duties of Waste generator

➲ Every waste generator shall,-

(a) Separate and store waste generated in three separate streams, namely biodegradable, non-biodegradable and domestic hazardous waste, in suitable containers and move separate waste to approved waste pickers or collectors as directed or notified from time to time by local authorities;

(b) Safely wrap the sanitary waste used, such as slides, sanitary pads, etc., in the pockets provided by the manufacturers or brand owners of these items or in the correct wrapping material as instructed by local authorities, and place the same in the pocket intended for dry or non-biodegradable waste.;

(c) Store in its own premises, as and when created, construction and demolition waste separately and disposal in compliance with the 2016 Construction and Demolition Waste Management Rules; and

(d) Store the horticultural waste and garden waste produced separately from its premises in its own premises and disposal from time to time according to the instructions of the local body.

➲ No waste generator shall throw, burn or bury the solid waste that it produces on the streets, in open public spaces outside its premises or in the drainage or water bodies.

➲ All waste generators shall pay certain user fees for solid waste management as set out in local authorities' by-laws

Applicability of these regulations

These rules apply to all urban local bodies, outgrowths in urban agglomerations, census towns as declared by the Registrar General and Census Commissioner of India, notified areas, notified industrial townships, areas controlled by Indian Railways, airports, airbases, ports, and harbors, defense establishments, special economic zones, state and central government organizations, Places of pilgrimage, religious and historical significance as may be informed from time to time by the respective government and to all domestic, educational, commercial and other non-residential solid waste generators located in the areas except industrial waste, hazardous waste, hazardous chemicals, bio-medical waste, e-waste, lead-acid batteries and radioactive waste that are covered under separate rules framed under the Environment (Protection) Act, 1986.

Every person indulged in waste management activity like solid waste management have to take prior approval of state pollution control board or pollution control board through application in Form-I and the board will examine the proposal for authorization and make such inquiries as deemed fit, after the receipt of the application for the same in Form I from the local body or any other agency authorized by the local body & may issue authorization within a period of sixty days in Form II to the local body or an operator of a facility or any other agency authorized by local body stipulating compliance criteria and environmental standards as specified in Schedules I and II including other conditions, as may be necessary;

State pollution control board or pollution control committee is responsible for monitor environmental standards and adherence to conditions as specified under the Schedule I and Schedule II for waste processing and disposal sites given in Solid Waste Management Rules, 2015

Criteria for Waste to energy

➲ Non-recyclable waste with a calorific value with 1500 K / cal/kg or more shall not be disposed of on landfills and shall be used exclusively for the production of electricity, either by refuse-derived fuel or by dispensing as feedstock for the preparation of refuse-derived fuel.

➲ High-calorie waste shall be used in cement or thermal power plants for co-processing.

➲ A request for authorization shall be sent in Form I to the State Pollution Control Board or the Pollution Control Committee, as the case may be, by a local authority or an operator of a facility or agency approved by them proposing to establish waste at an energy plant with a capacity of more than five tons per day.

➲ The State Pollution Control Board or Pollution Control Committee shall review the same and grant permission within sixty days after receiving such a request for the establishment of waste at an energy facility

Procedure and Documentation

Procedure for registration:

a. Fill the requisite form that forms I, II, or III as per the kind of business

b. Attach all the required attachment with forms

c. Documents should be signed by an authorized person

d. Submit the form to the concern SPCB or pollution board

e. Do the liasoning with concern department

f. IF the form is proper and fine the department will grant the certificate

d. Rent/lease/ proof of ownership

e. Factory license/trade license

f. Electricity bill

g. Layout/plan

h. CIN(certificate of incorporation) in case of company/LLP

k. Board resolution for appointing the authorized person

Space Requirement for Recyclers

As a general rule, a recycler of the capacity of 1 ton per day shall require a minimum of 500 square meters area. Authorization to recyclers may be preferred if they have a minimum operational capacity of 5 MT/day with an area of about 2500 Square meters.


The Storage capacity of any collection center should commensurate with the volume of operations (weight and number) and the category of E-waste. Space needed for storage of different category of e-waste is given below:

Q. To whom this rule is Applicable?

This rule shall apply to every producer, consumer, or bulk consumer involved in the manufacturing, selling, purchasing, and processing of electrical and electronic components as specified in schedule-1.

 

Q. Validity of registration?

The registration granted under these rules shall be valid initially for a period of two years and thereafter for a  period of a maximum of 5 years on subsequent renewals from the date of its issue unless the operation is discontinued by the unit or registration suspended or canceled by the state pollution control board.

 

Q. How to renew the registration?

An application for renewal of registration shall be made in form-4 before sixty days of its expiry and the state pollution control board or pollution control committee may renew the registration after examining each case on merit and subject to the condition that there is no report of violation of the provision of the act or the rule made thereunder or conditions specified in the registration.
